2017– Our client Mrs. A. Kiyani whose application for residence under the skilled migrant category was declined by Immigration New Zealand. The resident application also included her husband, aged 44 years and the couple’s three children, aged 15, 14 and 4 years.
Their application was declined by Immigration New-Zealand due to the fact that her spouse did not have an acceptable standard of health and was not granted a medical waiver. Our adviser Mr. Maraj Ahmed was not satisfied with the INZ’s decision and decided to lodge an appeal to the Immigration and Protection Tribunal New Zealand.
On Oct 12, 2017. The Tribunal issued the decision and endorsed the plea of our adviser that the application was incorrectly declined because Immigration New-Zealand failed to consider a medical waiver for the applicant’s husband. Currently, now this application has been returned to Immigration New Zealand for a correct assessment.
